NEIL FLAXMAN: As a trial attorney and a mediator, I can gauge how much forcefulness is appropriate in any mediation. And I am forceful, and I will be as forceful as the mediation rules allow. My negotiation skills not only include my training as a mediator through the American Arbitration Association mediation course and the mediation servicing course, but also as a negotiator for collective bargaining agreements over the past 33 years.
A mediator should have knowledge of the law. I have been litigating for over four decades, both in the federal and state system through the appellate level. I'm Board Certified in Labor and Employment law and have been so certified since the beginning of the certification program. And I am listed in Martindale Hubbell's publication of preeminent attorneys. I understand a mediator's job is to get a settlement effectuated which is satisfactory to the litigants and the attorney.
